The five men accused of robbing missing German tourist Nick Frischke are set to make another appearance in court on Tuesday, 29 August 2023, as the investigation into his disappearance continues.

Nick Frischke suspects face murder despite body still missing

Frischke, who was last seen hiking along the Hangberg trail in Hout Bay on Valentine’s Day 2023, has not been located despite extensive efforts.

As reported by EWN, the National Prosecuting Authority (NPA) expressed its intention to include a murder charge in the suspects’ charge sheet, despite the absence of Frischke’s body.

This decision raises questions about the legal and evidentiary challenges involved in pursuing a murder charge in the absence of a victim’s body.

Legal experts highlight that establishing a murder charge without a body can be complex, as prosecutors typically rely on forensic evidence and post-mortem examinations to determine the cause of death and gather crucial evidence.

In cases where a body is not found, prosecutors often face the uphill task of proving beyond a reasonable doubt that a person has indeed been murdered.

During the suspects’ previous court appearance, prosecutors emphasised that Frischke’s disappearance had implications beyond the immediate case, as it contributed to an image of South Africa as a dangerous destination for tourists.

The accused were reportedly found in possession of Frischke’s belongings, raising suspicions that they may possess information critical to the investigation.

The State contends that they might be withholding vital details about the circumstances leading to Frischke’s disappearance.
