Sean “Diddy” Combs’ defence lawyers have filed an urgent application asking the court to release him on bail while he awaits sentencing.
Diddy could be released on bail after skirting federal sex trafficking charges
This follows a recent court decision that found Combs guilty on two lesser charges but cleared him of the more serious accusations of racketeering and sex trafficking.
The bail application argues that Combs, who has been in custody since September 2024, no longer poses a flight risk or danger to the public.
His legal team stressed that the charges he was convicted of—transporting people for prostitution—carry a much lighter sentence than what he initially faced.

The two charges under the Mann Act carry a combined sentence of up to 20 years, but his legal team estimates a more realistic sentence range of 21 to 27 months.
Since Combs has already served 10 months, his lawyers argue that keeping him behind bars is unnecessary.
They noted that “Mr. Combs has been given his life by this jury,” referring to the not guilty verdicts on the most severe counts .
The defence also pointed to Combs’ behaviour since the investigation began. They argue that he willingly cooperated with authorities, turned over his passport, and even moved to New York to face charges.
His lawyers noted that Combs paid off his $18 million home in Miami so it could be used as bond security .
What’s the likelihood he’ll get bail?
The US Department of Justice opposes the bail request. Prosecutors argue that Combs is still a threat, pointing to evidence of “prolific drug use” and his alleged continued criminal activity even after learning he was under investigation.
They say he should remain in jail and are asking the court for a prison sentence.
Judge Arun Subramanian has not yet ruled on the bail application. He requested written statements from both legal teams and is expected to make a decision after reviewing them.
In their submission, Combs’ legal team proposed several bail conditions:
- A $1 million bond.
- Signatures from Combs, his mother, his sister, and the mother of his oldest daughter.
- Travel limits to specific U.S. districts.
- Continued surrender of his passport.
- Drug testing as directed by pretrial services.
The court will now decide whether these conditions are enough to allow Combs to stay out of jail until sentencing.
For now, the music mogul remains in custody as he awaits a final decision on his bail status.
