The Senzo Meyiwa murder trial resumes today at the Pretoria High Court, where accused number one, Muzi Sibiya, will continue to face questions from his defence lawyer, Advocate Charles Mnisi.

On Tuesday, Sibiya told the court that he was being denied justice because crucial evidence, Automatic Vehicle Locator (AVL) data from police vehicles, was not presented during his cross-examination.

“There is no justice for me,” Sibiya said as the State concluded its cross-examination.

He argued that the missing tracker information could have verified the movements of police vehicles on the day of his arrest, potentially supporting his version of events.

“The issue of the AVLs not being brought before court is not justice to me,” he told the court.

“The JMPD officer who came here to testify said their vehicles had AVLs fitted. If those AVLs were here, they would have shown the movement of the car and proved the times as I testified.”

Sibiya also alleged that he was assaulted by police before signing a statement that prosecutors are using as evidence against him.

Responding to Mnisi’s questions about his condition at the time, Sibiya said he was not in a sound state of mind when he met with Colonel Nkosikhona Radebe, who had testified that Sibiya appeared coherent.

“That is not true. I was not okay when I met up with Radebe. I could not have been in my sober senses because I was assaulted by the police,” he said.

“I signed everything I was told to sign because I was assaulted.”

Sibiya’s lawyer is expected to continue re-cross examination today, focusing on the State’s handling of physical evidence and witness statements.

The Senzo Meyiwa murder trial, which has been ongoing for more than three years, relates to the 2014 killing of the Bafana Bafana captain at the Vosloorus home of his girlfriend, singer Kelly Khumalo.

Five men have been charged with murder, robbery, and possession of unlicensed firearms. All have pleaded not guilty.

The court will continue hearing testimony through the week as both sides prepare to close the cross-examination phase.
