What to expect from the Senzo Meyiwa trial today
Advocate Charles Mnisi is expected to continue his cross-examination of Brigadier Bongani Gininda, the lead police investigator in the case. Mnisi represents accused number one, Muzi Sibiya, and his questioning is centred on how Sibiya was arrested and implicated in the murder of the former Bafana Bafana goalkeeper.
In court on Tuesday, Mnisi challenged the reliability of statements used to implicate his client. He focused particularly on hearsay evidence from Absolum Zungu, who claimed to have received information from another individual named Mbekiseni.
Mnisi pointed out that this chain of information included a third unnamed person, raising concerns about its admissibility. Judge Ratha Mokgoatlheng noted that an application must be brought if the defence intends to rely on such hearsay, and that the state may have to call Absolum Zungu to testify directly.
Mnisi also pressed Gininda on whether any further investigation was done to verify the claims made in these statements.
Gininda confirmed that investigators tried to contact the source but were unsuccessful, and they proceeded to analyze cold case files, which led them to additional charges against Sibiya unrelated to the Meyiwa case.
The cross-examination delved into a prior arrest of Sibiya in March 2019.
Mnisi claimed that Sibiya was questioned about Meyiwa’s death during that arrest. Gininda denied this, saying that the 2019 arrest was strictly related to a drug case in Tembisa and that there is no evidence in the official docket linking that incident to the Meyiwa investigation.
He stated that Sibiya only became a suspect after further investigation in 2020.
The questioning then turned to how the arrests and subsequent confessions of Sibiya and accused number two led to a broader investigation. Mnisi pointed out that the confessions and pointings out were used to guide further inquiries.
Gininda confirmed this and said the investigating team was in continuous contact with prosecutors for legal guidance during that phase of the investigation.
Advocate Zithulele Nxumalo informed the court that Advocate Zandile Mshololo will not be present for the rest of the week due to an emergency. Judge Mokgoatlheng responded that a formal explanation must be submitted.
Today’s court session is expected to build further on these testimonies.
Mnisi may continue to question the sequence of events leading to Sibiya’s arrest, the legal standing of the statements introduced, and the timeline of the investigative actions taken by Gininda and his team.
